Job Offer Requirements: The Job being offered must be Full-time in nature meaning that the duties being performed should be for a minimum of 30 hours per week and a minimum of 1560 hours in a year. It must also be a Permanent position with no specified end date. It should not be a contractual or a seasonal hiring and the job offer should not be affecting the employment of an employee who is involved in a Labor dispute with the employer.
In addition, the job offer should be for an eligible job falling in the New NOC / TEER 0, 1, 2 or 3 Job classification and the pay for that job should be either equal or higher than the Median Wage for that occupation in that specific region. The Job Offer position must be integral to the employer’s business and the employer must be able to maintain or grow the current business after filling in the said position. Needless to mention that the work being done for this position must be primarily occurring in Ontario.
Applicant Requirement: Wherever applicable the applicant must have the required licenses or authorization that are considered mandatory for performing that role in that province and if the occupation has no such mandatory requirement then the applicant must have demonstrated at least 2 years of cumulative paid full-time work experience within the past 5 years. The applicant must also have a genuine intent to live in Ontario after gaining PR and if applying from within Canada, the applicant must have legal status at the time of applying and must maintain status until the nomination is received.
Employer Requirement: To be considered an eligible employer, the employer’s business operations should have been active within the province of Ontario for at least three years prior to submitting the application. The employer must also show that reasonable efforts were made to hire a Canadian Citizen or a PR before offering the position to this individual and the employer can then hire the applicant either based on a valid work permit that the employee already has or a positive LMIA.
In addition, if the employer’s business location is within The Greater Toronto Are (GTA) then the employer must be able to meet a Gross Annual Revenue of $1,000,000 and must already be hiring five full time employees working at the same location who are either Canadian Citizens or Permanent Residents. For a business location that lies outside of The GTA, the Gross Annual Revenue requirement is $500,000 only and the number of employees who are citizens or PRs is also only 3.
