A TRP is a means for otherwise inadmissible applicants to enter Canada or extend their stay in Canada.
An Inadmissible individual is someone who is found to be unfit to enter Canada because of one or more of the following reasons: • Security risk to Canada • Criminal history • Human rights violation • Financially unable to support oneself • Medical issues that could be a burden to the Canadian Taxpayer • Misrepresentation on prior application • An inadmissible family member • Non-compliance to one of the conditions of prior legal status in Canada.
In such cases, the onus is on the applicant and his/her counsel to convince the Visa officer or a CBSA officer that the need for the applicant to enter Canada or continue staying in Canada is far greater than the potential risks to the health and safety of the Canadian society. Once convinced, the officer may issue a TRP for a duration that is deemed appropriate in the current scenario.
