This program allows Canadian employers to hire foreign nationals because of their inability to hire a Canadian citizen or Permanent resident to fill up a vacant position in the organization. The program works through a close collaboration between Immigration, Refugees, and Citizenship Canada (IRCC) and Employment and Social Development Canada (ESDC).
How Does It Work?
• An employer first attempts to fill the vacant position by trying to find a suitable candidate from within Canada • Having failed to find a suitable Canadian, the employer submits an application with ESDC to receive a positive LMIA • ESDC then conducts a Labor Market Impact Assessment to assess the impact of this hiring on the Canadian job market • Based on the findings, ESDC then issues a decision on the LMIA application • If the decision received is a positive LMIA then it can be used to apply for a Closed work permit for the applicant • This closed work permit then allows the candidate to travel to Canada and start working for the employer
