This is a program that has been tailored for enterprising individuals from all over the world who have an innovative idea for setting up a business in Canada. It should not be looked at as a pure investment program where the applicant is looking to gain Canadian Immigration just on the basis of a monitory investment done in the Canadian marketplace nor is this program meant for traditionally known businesses such as restaurants, retail stores, franchise opportunities etc. The applicant in this case must have an active involvement in the business being setup even though there are Canadian incubators or investors involved.
It’s a two pronged program that results in economic gains for the individual through the business and also eventually results in a Permanent Residency to Canada. This program also follows a faster process with the applicant having the possibility to move to Canada on a Temporary Work Permit while he/she awaits the permanent residency status.
* The business being setup can have upto 5 different applicants applying as owners and each applicant must have at least 10% of the voting rights in the business.
* In addition the applicants along with the designated organization must hold at least 50% of the voting rights in the business.
* At the time of receiving Permanent residency the business must be incorporated in Canada, must have a major part of the operations within Canada and the applicant must be actively managing the business from within Canada.
The applicant is required to obtain a letter of support from an organization that has been approved by the Canadian government to support and invest in businesses under the Start-Up Visa program. Such organizations are referred to as Designated Organizations and they are broadly of three types:
* Venture Capital Funds – The designated businesses under this category must agree to invest at least CAD $200,000 in the start-up.
* Angel Investors – The designated businesses under this category must agree to invest at least CAD $75,000 in the start-up.
* Incubators – No minimum financial investment involved but the applicant must be accepted into one of the eligible program. The list of various Designated Organizations can be found on The Government’s website.
This program does not have a lot of minimum requirements that involve a clients prior education, work experience etc. But to ensure that the client manages to blend in well into the Canadian workplace, he/she is required to achieve a minimum score of CLB 5 in all the four areas (Speaking, Listening, Writing, Reading) of language testing in either English or French.
The applicant must be able to prove that he/she has the required funds to support themselves and their families once they arrive in Canada. This amount must not borrowed and depends on the size of the family. The list of various Designated Organizations can be found on The Government’s website.
